What are the key messages of the Save Our Children’s Rights campaign?

• Children and young people with SEND currently have a clear set of legal rights and entitlements that ensure access to education that meets their individual needs.
• This statutory framework is fundamental to equality, inclusion, and accountability. It should not be weakened in the name of reform or cost-saving.
• Any Government reform must preserve these protections and must not substitute enforceable rights with statutory or non-statutory guidance.

Why do legal rights matter?

Legal rights ensure that children and young people can:

• Access education equally, regardless of need or disability.
• Have their needs assessed and supported appropriately.
• Be protected from exclusion and discrimination.
• Challenge unlawful decisions through the SEND Tribunal.

What happens if legal rights are weakened?

• Safeguards that ensure children receive the support they need are removed.
• Reducing legal rights will not reduce children’s needs, it will only reduce the support available to them.
• Many children would lose access to appropriate education, which could widen inequalities, and minority groups would face even greater barriers to support and inclusion.
